INSURANCE QUESTION?

Do we have someone in the forum that could advice us on this:
In June 2005 I bought a 2004 SuperHawk in July I was hit from
behind at a stop sign very long story memory overload.
The driver that hit me had USAA (I have state farm).
Damage to the sh $4000.00, no permanent injury to me thanks to
protective clothing. SH repair I cannot tell the difference great job
by Atlantic Cycles (no connection).
At the emergency room that is were revelation came.
Your health insurance does not cover motor vehicle accidents and according
to the USAA representative no (2005) insurance company will write a
personal injury policy for anyone on a motorcycle.
The only way our injuries are covered is if the other vehicle is at fault
and the driver has insurance. Other wise we are not cover for injuries
at all. Do I have this right????

Wow. Hope that's wrong. I've had thousands of dollars of m/c crash related medical treatment and always have minimum coverage on the bikes. My work HMO has paid for it all but deductibles and the only thing I've ever had to prove is that I didn't have any other coverage. Might be different state to state or company to company, or even representative to representative! Good topic to discuss.

Very rare your vehicle insurance will cover injury/medical unless you specifically ask for it... I did ONCE... but adding $1800 a for 6 months in premiums wasn't worth it.

I know Farm Bureau will cover medical bills with full coverage. (Haven't had to use it, thank god.) I check the policy every spring to make sure it will cover everything.

Are you referring to if it was the accident was your fault or you crashed and where injured? If thats the case I'm pretty sure that they wont pay for you only the person if any that you injured. one of the many reasons I love being in the military especially when I see the hoops and struggle that allot have to go through to get medical care. Even worst with all these people trying to scam and not have insurance.

Yes Misfitoy I checked all my policies and in (MD) I have Personal injuries on the car,
truck, suv, but not on the bike. Like Peterpanic wrote it could be a state thing.
Because it was the nurse at the ER that told me that health insurance would not
cover this and the USAA agent who said no one is issuing PI for motorcycle riders could
be just this state USAA did pay for the er visit.

That's pure bullshit. Insurance companies normally send out a letter stating that you are not covered, just hoping that you will say "ok". They save millions on people who do not push the issue.

You have to call a lawyer and he will send out a letter or two and they will pay.

My boss got hit while on the side of the road. The driver had no insurance so he put the claim in to his own insurance company ($1 mil uninsured motorist policy). They said that they were sorry, but he was not covered because he was not driving a vehicle at the time of the accident. His attorney wrote a letter to the company and they still refused. His attny then wrote a second letter stating case laws and he got the full ammount.

They all just try to save $$ by refusing at first. It costs them nothing to deny a claim. However, you need to have the uninsured/underinsured motorist coverage on your policy.

Yup you gotta remember insurance companies are in business and make money by giving out the least amount (if any) of money to you. Usually they will try and say their or your policy isn't covered or some other BS but like mentioned, when push comes to shove (an attorney), they will usually change their tune.

Like he said above. They try and save $$$ by refusing you at first because it costs them nothing that way. Most people would rather roll over and play along but there are others that will fight it, as they should.

Thanks I am going to start looking for a lawyer that does motorcycles cases
and save the info to be ready for the next one.

Please keep the forum posted on this one. AMA and other organizations are pushing a new bill in Congress, backed by several lawmakers, that is intended to close a loophole in insurance laws that allow insurers not to pay out in cases of accident involving powersports vehicles. If anyone wants more info, check the AMA website.
