I Hate Chip & Tar!!!!!!!!!!!

I was out for a ride yesterday, about 5 miles from home. I just moved back here to Greenwood, IN two weeks ago, so I was riding the speed limit (45 mph) and being careful. I was going down a road that was recently tarred (which I found out a little later). It had rained all morning, but had quit. It was still cloudy, so there was a small amount of water on the road still, but no puddles. The road was crowned a little so water would run off. I was just riding along when my tail kicked out right. My tail then switched to the left, then snapped hard right and I lost it. I am a little sore, but my bike is torn up bad. Oh, and my rear tire has about 800 miles on it. So, my deduction is that the accident was caused by road conditions. I got an accident report, and the officer agreed that it was the road that caused the accident. I know if you get a flat tire that is caused by a pot hole, the highway department pays for it. I think they should pay for my repairs so I don't have to turn this in to my insurance. Right now, because fo the move, I can't even afford to pay the deductible on m insurance, so I'm really screwed.

I wouldn't bet on getting anything out of the highway dept for this but it never hurts to try... Good luck and glad to hear you are OK!

Some Possible Good News

Well, I talked to a lawyer today, and he said I will need to file a Tort Claim. He said the county will probably not want to deal with this and just turn it in to their insurance company. If that happens, I think they'll total it and just give me the money. If that happens, I will probably be saying fair well for a while. I'll give up the riding for a bit.

Don't forget your lawyer will get AT LEAST 33% of any settlement, so it may not be worth it.

Really sucks that you wrecked, glad you walked away.

Lawyer's a family friend, so I just got advice. Don't need the lawyer for the Tort Claim.
