Chain hitting exhaust?

So when I got the bike I noticed the chain was touching the exhaust. It was a new chain figured it just wasn't adjusted properly. I just checked it and it's right at the 1 3/8th adjustment. When I get on the bike the suspension loads up and it's fine but is that normal?

Is the chain the correct number of links?

I set it to rub when the wheel is turned backwards but not when turned forwards.

as far as im aware its the correct chain it was on the bike when i got it. I need to go through and count the links when i clean the chain. still waiting on my lift stands to come in. its just barely touching the exhaust if i lift the chain and drop it you can hear the ping but its not like full slack resting on it.

When that happens with my VTR I know it's time to adjust the chain.

turns out im just dumb... The bike leaned on the kickstand it hits the exhaust when i have it upright though there is a dimple in the pipe and it clears pretty well.
