2nd day of rehab today and I'm feeling even better overall. Have physical therapy tomorrow, and hopefully getting MRI's this Friday. Even better news, after I was done with my appointment today, I got a call from my attorney telling me the crash report was finally available from the State Troopers office, so I picked it up and on the way to drop it off to my attorney's office, I read through it and the other guy is in full fault!! I made a copy of it and I'll be framing the report, lol.
I also reread my previous emails to my attorney and finally decided to be a little more proactive. I upped my lowest repair price and lowest totaled out price. I explained that my gear and bike protection were made to cut damages in the case of a spill/road debris/etc. on it's own, not protect my right leg from being severed at the knee or take on a few ton minivan driven by a negligent driver who failed to take responsibility. I told him that I needed to protect myself even more from people like this guy, who was telling everyone and his insurance that it was my fault that I was run into by him. I was being generous before. Tired of getting the short end of the stick, I feel that I deserve to be treated like a human being and not just some statistic.

Getting my MRI's done Wednesday, finally, after my morning session of rehab. Just trying to keep a positive outlook on everything, and thanking my lucky stars I'm not one less limb and able to function as well as I can right now.

Just wanted to put in a little update for everyone on here. Been moving around a lot easier on my legs, PT has been helping immensely there, MRI's were Wednesday, and awaiting a specialist to give me time for an appointment to review the MRI's and see if I'll be needing surgery or not. Been doing pretty good recovering physically, but broke down a few times mentally from the frustration of not being able to use my hands

All the while, the other guy's insurance is giving my attorney the run around a bit; not answering calls, saying they haven't seen the crash report (that I personally went and picked up and dropped off) so now out of the blue he's going to have a "scene investigator" to look at the location of the crash, plus had the gall to ask what I did for a living?! If my attorney doesn't hear from him by next Wednesday, they'll go over his head to his supervisor and put pressure on it even more with the possibility of a law suit that my attorney is well prepared for. All this because the guy swears he wasn't at all in the wrong for turning left into me from the outside lane while I was on the inside lane at a roundabout, and blamed me for getting run into.

They never did move my 'Hawk like he said they were going to do, then I found out it was still at the towing yard after I went to the location where it was supposed to be and it wasn't there

Just wanted to throw in another update here since its been over a month. Still fighting the other guys insurance, they sent out another scene investigator, because apparently the first one showed nothing in their favor. So, got more of my X-rays and MRI's done, so I was actually left with the following injuries...

-2 small fractures in my left shoulder (healed)
-fractured trapezium in my left hand, which has now healed but left with tissue damage (MRI and x-ray confirmed)
- broken right ring finger that has healed crooked - 90* movement currently (surgery not recommended currently and looking into ER x-rays)
- hematoma on my left shin (was the size of a softball)
- torn meniscus in my right knee (getting better with squats daily)
- sprained right ankle (better)

Other than that, I'm good, lol.

Well, at least your feeling good. You see, this is what I hate about insurance companies. Pay me, but don't call me if you need anything, I'll do my best not to pay !?

The system we have up here, is not perfect, however, much more hassle free. We have a 'no fault' system. Since you have had your accident in August, I would have already receievd settlement with my insurance company for my damage, and they then assume the trouble of pursuing the other parties insurance company, leaving me out of this fight.
As for my clothing and lost of work/revenu, this is with the DMV. They'll
even pay up to 1000$ for clothing.

Once again, not perfect, cause all this sometimes comes with a price tag, however, when your in a hospital, you can concentrate on getting well, and not on, 'am I going to get payed...and when'

damm Andrew, looks like you're all ready for Halloween........aaaah, who needs skin anyway.

glad to hear you're healin well. Hope you're gettin a lot of natural D3 down there in the sunshine state cause that'll do wonders for fast healing.

Maybe it's good the insurance is putting you off so you can add that to your pain and suffering......up the ante a little.

I've had state farm all my life, and I had to put the squeeze on them the few times I needed to use it to get what i had coming. Just the nature of the beast.

Keep on healin and dealin................. and happy halloween

FL is a "no fault" state as well. I'm in good spirits though, its a bit rough, but yeah, I'm concentrating on getting better instead of when I'm getting paid. My attorney is actually a pretty darn good one that keep up on the opposing party, without putting pressure on them. Not going to forfeit my medical compensation

Oh, my pain and suffering is surely going up as the weeks pass and I'm not able to use my hands the way I used to. I could barely squeeze a CVT clutch together to get a belt on a scooter of mine today, felt so pathetic I'm not hoping for a million dollars or blood, but I do want to be treated fairly and like a human being. I have a good 40 years left on me, so I should at least be able to get to enjoy myself for that time.

I'm actually having cold laser therapy performed on my hands, knee and ankle, as well as regular physical therapy. It's pretty neat since it supposedly promotes blood/fluid flow through those areas. Low level laser therapy - Wikipedia, the free encyclopedia

PT today to see if I get can more movement out of my finger and thumb, Dr. visit tomorrow to see if I get the ok to start getting back to normal and pursue further on the guy that hit me.

Also contacted my attorney to find out the specific location of my bike, or if it's never been moved so I can look it over with a level head now that I'm not in much pain.

Keeping my head up through all this is tough, but it's the norm around these parts

good to hear your gettin it together. Takes time and exercise helps speed up recovery. It's one day at a time and really, though we don't typically think in those terms, it's that way for all of us.

Gonna be interesting to see what shape the bike's in huh.

don't eat all the kids halloween candy.
