Here is the link to the auction. This guy is no top seller by all means, but you never know.

I have used the ebay guarantee program sucessfully.
I think the best way is to actually speak to a representative at ebay as opposed to attempting to resolve via email. Good Luck!

yup thats your best bet, shame things happen like this, i ind you leave some nasty negative feedback and people are quick to resolve your issue for you and to ask for you to change the feedback score.

is there a chance it was damaged during shipping?

Eddie - something similar happened to me back in December and EBAY stepped in and made it right.
First contact the seller and tell him what is wrong. Provide details - pics will help. Specifically ask for a FULL refund. Full includes shipping costs. If he doesn't respond or if he argues, take it to EBAY resolution center. They will ask each of you to present your side of the story. You only get one chance and ther is no appeal so write up your side with great detail.
They will make a final determination who is right and who is wrong. If you win EBAY will reimburse you and go after the seller on their own. It is possible that they will say both the seller and the buyer have a legitimate case (this is what happened to me) and ebay will still reimburse you and from what I can tell they eat it.
REMEMBER provide a detailed logical case. Take pics to support your position. Start with the seller and then elevate if no satisfaction.
Good luck

I was crossing my fingers that he wasn't gonna post one of my auctions!

Believe it or not Eddie, eBay is on your side from the get go, when buyers are afraid to buy online eBay loses a lot of money. They used to only cover payments made via PayPal, but they now cover all approved payment methods. Like it was said before, try to work it out with the seller, if he is unresponsive then take it to eBay.

It is disappointing when you do not get what you were hoping for. But you can clearly see in the ebay listing photo that the piece behind the mirror is missing ! Did you ask any questions before you bid ? You have also said the broken off part was never there from the start because it has been painted with the part missing. Maybe the seller honestly didn't know what he was selling, there are some honest people that make mistakes. Try contacting the seller & explain your situation & if no luck then take it to Ebay. I do feel for you, but as i said you can see in the listing the part is missing. If you can not resolve the situation it may be possible to visit a bike wreckers to get the missing part & get it plastic welded. Good luck with it all.

When I bought my entire SH it looked great in all of the pictures. And with only 4500 miles when I bought it I figured how bad could it be. Lets seee...
New left, right and front fairing, new windshield, repaired/painted rear fairing and repaired and painted tank. Now it looks great! Who knew? Now I can spot bad parts from pics.

"Small crack from bike falling over in garage has been repaired and cant even be seen. painted origional red and ready to be fitted to your bike."

Sounds like the guy is trying to pull a fast one. His quote indicates no other damage and we're not talking a scratch here. If he knew so little about what he was selling that he overlooked a piece that big missing from it he should get out of the parts selling business until he does.

i agree dan I started a claim with the ebay program so the selle calls me today and said he just took it off his bike there was nothing wrong and that it fit his bike fine he said people mod bikes all the time and he said he wasnt going to give a refund so i guess we will let ebay handle this situation

You might try what I did.

I bought a Simpson Street Bandit helmet off of Ebay last winter. The *** clown emailed me two weeks later saying the helmet was back ordered from Simpson. No problem, winter time. He puts me off a couple of times past the 45 day limit that PayPal has so they were absolutely useless to me. (They're basically useless even before the 45 day cutoff period) I then contacted my credit card company and told them the story. They pulled the funds from PayPal. I didn't know they could do that. At any rate I got a full refund. Your CC company is your best bet to resolve this.

I NEVER buy from a seller with less than 95% feedback.

Yeah I guess it's easy for me to say after the fact but you can pretty clearly see the missing piece in the photo. That said he's an *** and should've clearly pointed that out anyway. It's the $50 shipping where you got hosed-I've mailed several of these and if you size the box right it'll only be $20-$25 to mail...sorry for your bad luck. It's hit or miss when you buy from someone who doesn't have alot of good feedback and is too lazy to post proper pictures and description of wear and damage.
